união estável - A armadilha para estrangeiro
Hello everyone,
Vim para o Brasil cinco anos atrás. Eu não sabia ler nem falar o idioma português, mas foi empurrada por minha ex-namorada para assinar união estável.
Eu nem sabia pra que serve esse documento mas ela me disse que era algo que poderia me ajudar aqui no Brasil.
Depois nos separamos, ela tomou todas as cópias do documento e os escondeu de mim. Agora ela mora nos Estados Unidos com o namorado americano e como ela não está vivendo atualmente no Brasil eu não posso desfazer o documento.
Aproveitei a lei de anistia e eu estou aqui no Brasil documentado, mas com medo de construir uma vida, sabendo que um dia ela vai voltar para tirar a metade de tudo que eu desenvolvo.
existem leis no Brasil que protege os estrangeiros contra esse tipo de situação?

Royal Gringo, acredito que no cartório onde foi feito o registro desse contrato de união estável esteja disponível uma cópia do mesmo.
Tente conseguir essa cópia e veja se nas cláusulas existe a possibilidade de rompimento unilateral do contrato (geralmente existe), onde uma parte pode romper o contrato independentemente da vontade da outra.
Acredito que não haja lei específica para proteger um estrangeiro de "Gold Diggers", aí seria melhor vc buscar orientação com um advogado especializado.

Recomendo procurar um advogado. Mas de qqer forma, é melhor se preparar pro pior, já q ela te fez assinar estes papéis. Pelo menos tente ver se é possível alegar que vvc foi induzido a assinar este documento sem saber o que era, talvez isto ajude.

She probably made you sign it to get a Green-card. How did she get to US after all?
Try to find out.
I do my best bet she used you to get into United States.
I met Brazilian girls living in US, and I can say for sure, they are all gold diggers.
If she gets married, she could be arrested in US for bigamy. You could use this argument to press her to get rid of this legal attachment you have with her.

I haven't spoken directly with a lawyer yet, only via e-mail. But I often receive very inconclusive responses and a strong incentive to hire them for an expensive process. Talking of 'gold diggers'; lawyers can be the worst of them, especially when they know that you are a foreigner.
I can prove that we are no longer together because I have been dating another girl for over a year now. And my ex-girlfriend has been living in the US for almost a year. I don't have any copies of the 'união estável', but I will go to the 'cartorio' to ask more about it.

Ok, so I feel it is time to fill in the gaps about exactly what happened at the 'Cartorio'. We arrived there with two witnesses (grand mother and a friend from her German Class). We were first attended by a young man who at first refused to accept the document, my ex-girlfriend became very angry and gave him a bit of a scare and then he accepted. He then asked me directly in English: "Do you understand Portuguese?" I responded "nao muito."
He seemed very concerned about me signing this document and was reluctant to finish the process, but we waited for a while and I distinctively remember receiving at least two copies of the document perhaps which was upon my ex-girlfriends request.
When we broke up, she destroyed one of the copies in front of me. Why would she do that? She had nothing to gain in doing so. Unless it was to make me believe that we were no longer legally bound. So I wouldn't try to 'desfazer' the 'união estável'. Or perhaps she made even more copies at the 'Cartorio' without my presence. Can she do that?
As bad as she sounds, I don't want to cause any problems for her, I just want to build my own life her in Brazil and start my own business without worrying about this.

2) se você quer construir sua vida aqui no brasil, é bom sempre praticar.
O que tenho a dizer não é muito diferente do camarada Navarre: procure um advogado tanto aqui como nos EUA, se possível, e verifique se sua ex não o usou para entrar lá por meio do documento comprovante de união estável. Caso ela o tenha usado, tirar dela o direito de morar nos States, enquanto garante sua estabilidade por aqui, será sua vitória.
No mais, força, coragem e juízo.

I know how hard is to be new in another country and have lack of experience with native language. I specially know how troublesome are experiences with local women.
The fact that you are British changes the scenario a bit.
I don't now how relationships between USA and Britain Crown are right now.
So, I cannot tell what kind of maneuver she used to gain clearance to move to US.
However, I am sure that she used you somehow to get there. It is obvious.
You have to take care of yourself.

Judicial System in Brazil tends to favor woman 90% of time. I am sure it's the same in England. So, do not fall for that story that Brazilian women are kind and loving. They are not. They are as same as all woman you've met before in your life, if not worse for lack of legal boundaries .
